Welcome to Belly & Beyond ("App"), operated by Belly & Beyond ("Company," "we," "our," or "us").

By downloading, accessing, or using the App and its AI assistant "Viona," you agree to these Terms & Conditions ("Terms"). If you do not agree, do not use the App.

1. Purpose of the App

Belly & Beyond is intended to provide pregnancy-related educational content, wellness tracking, journaling, reminders, organizational tools, and AI-generated informational support.

The App is designed for informational and wellness purposes only.

The App and Viona do not provide medical diagnosis, treatment, medical monitoring, emergency services, or professional healthcare advice.

2. No Medical Advice

Important: The App does not provide medical advice.

Information provided through the App, including responses generated by Viona, is not a substitute for licensed medical advice, diagnosis, treatment, prenatal care, emergency medical services, or professional healthcare consultation.

Always seek advice from a qualified healthcare provider regarding pregnancy concerns, symptoms, medications, mental health conditions, infant health, or medical emergencies.

Never disregard professional medical advice because of information obtained through the App. If you believe you may be experiencing a medical emergency, contact emergency services or a licensed healthcare provider immediately.

3. AI-Generated Responses

Viona uses artificial intelligence to generate responses. AI-generated content may be incomplete, inaccurate, outdated, or unsuitable for professional healthcare guidance.

You acknowledge that AI systems are probabilistic, responses are automatically generated, and the Company does not guarantee accuracy, completeness, or reliability.

You remain solely responsible for decisions made based on information provided by the App.

4. Emergency Situations

The App is not intended for emergency use.

Do not rely on the App for urgent medical conditions, including severe bleeding, chest pain, breathing difficulties, seizures, suicidal thoughts, severe abdominal pain, reduced fetal movement, loss of consciousness, or infant medical emergencies.

In emergencies, immediately contact local emergency services, your doctor, or the nearest healthcare facility.

5. Eligibility

You must be at least 13 years old to use the App. If you are under the age of majority in your jurisdiction, you must use the App under parental or legal guardian supervision.

6. User Accounts

You may be required to create an account to access certain features. You agree to provide accurate information, maintain account security, and notify us of unauthorized access.

You are responsible for all activities conducted under your account.

7. Health and Personal Data

The App may collect pregnancy-related information, due dates, wellness tracking data, journal entries, mood logs, symptom entries, and chat interactions.

Your use of the App is also governed by our Privacy Policy. We implement reasonable safeguards, but no system can guarantee absolute security.

8. Prohibited Use

You agree not to misuse the App, attempt unauthorized access, interfere with system functionality, upload malicious software, impersonate others, use the App for unlawful purposes, distribute harmful content, or rely on the App as a replacement for licensed healthcare services.

9. Intellectual Property

All content, branding, software, designs, graphics, and AI systems associated with Belly & Beyond are owned by the Company or its licensors and are protected by applicable intellectual property laws.

You may not copy, reproduce, distribute, reverse engineer, modify, or commercially exploit any part of the App without written permission.

10. User Content

You retain ownership of content you submit to the App, including journal entries, notes, uploaded content, and personal records.

By submitting content, you grant us a limited license to store, process, display, and operate the App functionality associated with that content.

You are solely responsible for content you submit.

11. Third-Party Services

The App may use third-party services including analytics, hosting, subscriptions, cloud infrastructure, and AI providers.

We are not responsible for third-party services, external websites, or third-party interruptions or failures.

12. Disclaimer of Warranties

The App is provided "as is" and "as available."

To the fullest extent permitted by law, the Company disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, availability, accuracy, and reliability.

We do not guarantee that the App will be uninterrupted, error-free, secure, or medically accurate.

13. Limitation of Liability

To the maximum extent permitted by law, the Company and its affiliates shall not be liable for indirect damages, incidental damages, consequential damages, emotional distress, loss of data, health-related outcomes, pregnancy complications, medical decisions, or reliance on AI-generated content.

Your use of the App is at your own risk. If liability cannot be excluded under applicable law, our total liability shall be limited to the amount paid by you, if any, for use of the App during the preceding 12 months.

14. Indemnification

You agree to indemnify and hold harmless the Company and its affiliates from claims arising from your use of the App, violation of these Terms, misuse of AI-generated content, or violation of applicable laws.

15. Suspension and Termination

We reserve the right to suspend, restrict, or terminate access to the App at any time without notice if we believe these Terms are violated, the App is misused, or safety or security concerns arise.

16. Modifications to the App

We may modify, suspend, discontinue, or update features of the App at any time without liability.

17. Changes to These Terms

We may update these Terms periodically. Continued use of the App after updates constitutes acceptance of revised Terms.

18. Governing Law

These Terms shall be governed by and interpreted under the laws of India, without regard to conflict of law principles.

Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of courts located in Punjab, India.
